Recently concluded a nine day jury trial in Carroll County Superior Court. Interesting case which involved both legal claims and requests for equitable relief relating to a right of way. The property owner sued three other lake front property owners for various intentional torts alleging common law trespass, timber trespass, trespass to stone and destruction of a property boundary (stone wall). After receiving testimony from both lay and expert witnesses, the jury and the Court returned verdicts fully favorable to my clients and the other defendants. The court orders contain an interesting discussion of NH law regarding trespass and damages for intentional misconduct. See: Kretschmann v.
